Burger Compress Terms of Service

Version: 1.0Last Updated: September 7, 2026Effective: September 7, 2026

Important Notice

These Terms are an agreement between you and Visionular, Inc. for the Burger Compress (汉堡压缩) website, account, template synchronization, updates, support, and future paid services. Installation and use of the desktop software are also governed by the Burger Compress End User License Agreement (“EULA”). Personal-information processing is governed by the Burger Compress Privacy Policy.

Please read carefully the provisions on account suspension and termination, payment and automatic renewal, disclaimers, limits of liability, governing law, and disputes. All limitations apply only to the maximum extent permitted by law and do not waive non-excludable consumer rights.

1. Contracting Party and Scope

“Visionular,” “we,” “us,” or “Licensor” means:

  • Visionular, Inc.
  • 280 2nd Street, Los Altos, CA 94022, USA
  • Email: info@visionular.com
  • Telephone: +1 (650) 279-7578

The “Services” include the Burger Compress website, downloads, accounts, device management, personal-template synchronization, software updates, customer support, and any paid plan expressly launched later. A third-party store's own account, payment, download, and refund services are governed by that store's terms.

2. Acceptance and Order of Documents

By creating an account, selecting an acceptance control, purchasing a Service, or continuing to use the Services after a reasonable opportunity to review these Terms, you accept them. If you do not agree, do not create an account or use online Services. You may still use core local processing as permitted by the EULA.

These Terms, the Privacy Policy, the EULA, plan rules shown at checkout or in an order, and any properly presented supplemental terms form the agreement. If they conflict:

  1. a separately signed written agreement controls;
  2. an order or checkout term specific to that transaction controls over these general Terms;
  3. the Privacy Policy controls personal-information processing;
  4. the EULA controls the desktop software license; and
  5. these Terms control the remaining Service relationship.

A store's mandatory transaction rules apply only to transactions through that store. No document excludes a mandatory consumer right.

3. Eligibility and Minors

You must have legal capacity to enter this agreement. A person below the local age of independent contracting must use the Services only with a parent or legal guardian's review and authorization. A user under 14 in China must also have valid guardian consent for online features that process personal information.

If you use the Services for a company or other organization, you represent that you can bind it; “you” includes that organization. It is responsible for its authorized users.

4. Services and Local-First Processing

Burger Compress converts, compresses, and otherwise locally processes images and video that you select. Media, thumbnails, file names, paths, local history, and media metadata are not uploaded by default. You must review picture, sound, format, compatibility, and integrity before using an output. The Product does not overwrite a source by default, but you should still keep backups.

Guests may use local core features currently offered. Signed-in users may use personal templates, advanced template settings, and cross-device template synchronization. If an online account service is unavailable, local core processing ordinarily remains available, but sign-in, synchronization, device management, update checks, or support may be impaired.

Features, formats, requirements, and performance depend on Product version, device, operating system, installed components, hardware capabilities, and release notes. Marketing does not promise unconditional compatibility, a particular compression ratio, speed, size, or output quality on every device and file.

5. Account Registration and Security

Provide accurate account information and an email you control. Product accounts use a unique email and password; display usernames may be duplicated. Do not impersonate another person or use an email you do not control.

Protect your email, password, devices, and session material. If you suspect unauthorized access, change your password, remove affected devices, and contact us. Except where Visionular failed to meet a legal security duty, you are responsible for activity conducted through your account while reasonable safeguards were in place.

At present, one account may keep up to five active signed-in devices. A sixth device requires you to select and remove an old device. A removed device may still use local guest functions. Device limits may change with free or paid plans after advance disclosure, but we will not unreasonably remove a previously purchased right retroactively.

6. Acceptable Use

You may use the Services and software output for personal, educational, creative, internal business, or lawful commercial purposes if you hold all rights needed for the input and output.

You must not:

  • use the Services for unlawful, infringing, fraudulent, harassing, hateful, exploitative, or privacy-invasive activity;
  • access an account, server, administration area, interface, secret, or other user's information without authorization;
  • distribute malware or conduct denial-of-service, scanning, brute-force, rate-limit evasion, or interference;
  • abuse verification codes, mass-register, sell or share accounts, or automate requests beyond a public interface and reasonable use;
  • bypass payment, license, device, security, access, integrity, or technical controls;
  • misleadingly resell the Services or claim Visionular sponsorship, certification, or endorsement;
  • remove rights notices or infringe a Visionular trademark, trade secret, or other right; or
  • help another person do any of the above.

The EULA contains the detailed restrictions on copying, modification, redistribution, and reverse engineering. Conduct expressly permitted by non-waivable law remains permitted only to the minimum extent of that law.

7. Your Content and Output

You retain your rights in input files, personal templates, and lawfully created output. Visionular does not acquire ownership of local media by providing the tool. You authorize us to process personal templates and support material only to synchronize, support, secure, and provide the Services you request.

You represent that you may process the input and are responsible for ensuring publication, commercial use, and international distribution of output do not violate copyright, publicity, privacy, trademark, confidentiality, or another right. Technical support for a format or codec does not itself grant a content, codec-patent, broadcast, public-performance, or commercial-distribution license.

We do not review your local media and cannot determine ownership or fitness for your intended use.

8. Visionular Intellectual Property

The Services, software, website, interface, branding, documentation, designs, code, algorithms, updates, and technology are owned by Visionular or its licensors and protected by intellectual- property laws. No ownership is transferred. Except for the limited software license in the EULA, all rights are reserved.

Without written permission, do not use Visionular, Burger Compress, 汉堡压缩, or a confusingly similar mark to imply sponsorship or endorsement. Fair, truthful reference to compatibility or source is not prohibited.

If you voluntarily submit non-confidential feedback, you grant Visionular a worldwide, perpetual, irrevocable, royalty-free, sublicensable right to use, modify, and implement it. This does not cover your media or material protected as personal information.

9. Third-Party Components and Services

The software may include open-source or other third-party components whose notices and licenses are provided with the software or on a notices page. Those licenses directly govern the components and these Terms and the EULA do not reduce the rights they grant.

Microsoft Store, GitHub, software stores, system-extension providers, payment processors, email delivery, and download hosting are operated by third parties. We remain responsible as applicable for processors we select and instruct, but do not control a third-party service you independently choose to access. Third-party terms and policies may apply.

10. Updates, Compatibility, and Service Changes

We may provide bug fixes, security updates, feature updates, and new versions. An update may be necessary to protect security, remain compatible with an online interface, or continue a related online feature. Automatic checking and download choices depend on Product settings and the store mechanism you use.

We may add, change, or discontinue features. We notify you where reasonably practicable of an urgent security, legal, or force-majeure change. Before materially reducing a paid core benefit, we provide reasonable notice and any continued performance, substitute, pro-rata refund, or cancellation required by law or purchase terms.

If we plan to permanently cease an online business or core online Service, we will give legally required advance notice and reasonably address prepaid rights, accounts, and personal information.

11. Beta and Preview Features

A version clearly marked internal test, Beta, Preview, or experimental may be incomplete, unstable, change data formats, or be discontinued. Unless law requires otherwise, it is provided as-is without a promise of general release. Do not use it as the sole copy or for production-critical or safety- critical work. Any specific supplemental beta rules presented with it control for that feature.

12. Free and Future Paid Services

The current public version is free to use. “Free” does not mean open source, a transfer of rights, or a promise that every future feature will remain free. Visionular may later offer premium features, subscriptions, one-time licenses, or commercial plans, but these Terms alone never authorize a charge.

Before payment, we clearly and prominently show the seller, plan, price and currency, billing period, taxes, trial, device or usage limits, automatic-renewal status, cancellation method, refund rules, and effective time. We charge only after your affirmative order and payment authorization.

12.1 Subscriptions and Automatic Renewal

If a plan uses automatic renewal:

  • renewal selection, price, period, and cancellation are prominent before purchase and chosen by you;
  • we or the transaction platform provide any legally required pre-renewal reminder, including the charge date, amount, and cancellation path;
  • you may cancel or change through a prominent, convenient account or platform control without an unreasonable fee;
  • cancellation normally takes effect at the end of the paid period unless checkout or law states that it is immediate; and
  • price changes are notified in advance and are not charged retroactively without authorization.

12.2 Refunds, Taxes, and Store Transactions

Refunds and withdrawal rights follow checkout terms, platform rules, and mandatory consumer law. The relevant store normally handles a purchase made through Microsoft Store or another store. A “no refund” statement never excludes a statutory refund, quality remedy, or withdrawal right. You are responsible for taxes legally imposed on you; tax-inclusive pricing will be identified.

13. Suspension and Termination

You may stop using the Services, sign out, or request account closure under the Privacy Policy. Closure does not automatically delete software or local files from your device.

Where there is reasonable evidence of a serious or repeated violation, security threat, infringement, overdue paid charge, or legal requirement, we may limit a related feature, revoke a session, or suspend or terminate an account. Except for urgent security, illegality, or inability to contact you, we give a reason and a reasonable opportunity to cure or appeal. A measure will be proportionate and will not without cause disable unrelated local core functions.

After termination, you must stop using terminated online or paid rights. Provisions that by their nature survive—including intellectual property, payment, liability, and dispute provisions—remain effective. The Privacy Policy governs personal information.

14. Support

The free version has no guaranteed response time or continuing-support commitment, but we use reasonable efforts through public support channels to address errors, security, and account issues. Any service level, maintenance term, or priority support in a paid plan is governed by the order or a separately signed agreement.

Support guidance is not a substitute for legal, financial, medical, security, or data-recovery advice. Maintain independent backups of important sources and business data.

15. Disclaimer

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Visionular does not promise uninterrupted or error-free operation, universal device or format compatibility, or a specific compression ratio, speed, quality, file size, commercial result, or data recovery.

Media operations may fail or produce unexpected results because of a damaged source, codec difference, hardware, system component, or selected setting. Keep source files, inspect output, and perform a small test before critical or large-scale work.

This section does not exclude a warranty that cannot legally be excluded or a consumer's rights to repair, reperformance, replacement, refund, damages, or another remedy for a defective product, failure to perform, or misrepresentation.

16. Limitation of Liability

To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, or punitive loss, or reasonably avoidable loss of profit, goodwill, opportunity, or data. This does not apply where law prohibits a limitation.

For a business or professional user, Visionular's aggregate liability arising from the Services and agreement is limited to fees actually paid for the affected Service in the 12 months before the event giving rise to the claim. If the affected Service was entirely free, the cap is USD 100 or a higher minimum required by law.

These exclusions and caps do not apply to Visionular's willful misconduct or gross negligence, fraud, personal injury, a violation of non-excludable privacy or consumer rights, or another liability that law does not permit us to exclude or limit. Mandatory consumer law prevails.

17. Business-User Indemnity

Only if you use the Services for business or organizational purposes, you will, to the extent permitted by law, indemnify Visionular for reasonable losses and costs arising from a third-party claim caused by your unlawful use, lack of rights in input, infringement, or material breach. We will promptly notify you and allow reasonable participation in the defense. This does not apply to ordinary consumers or loss caused by Visionular's own fault.

18. Export and Sanctions

Do not download, use, or provide the Services in violation of applicable export-control, economic- sanctions, or import law. You represent that you are not in a location or on a list to which service is legally prohibited. This section does not require action that would violate law binding on you.

19. Force Majeure

We are not in breach for delay or interruption caused by an event beyond reasonable control and not reasonably avoidable, such as natural disaster, war, public-health event, widespread network or infrastructure failure, supplier failure, or government action. We will use reasonable efforts to mitigate effects. Payment, privacy, and other non-waivable legal duties are not automatically excused.

20. Changes to These Terms

We may update these Terms for changes to the Product, business model, law, or security, publish the date, and retain accessible prior versions. We give reasonable advance notice of a materially adverse change through the Product, website, account email, or another prominent channel. We obtain renewed acceptance when required. If you reject a material change, you may stop the affected online Service, cancel renewal, or request account closure before it takes effect. An update will not retroactively reduce a completed transaction's rights.

21. Governing Law and Disputes

This agreement is governed by California law, excluding conflict-of-laws rules. If you are a consumer, this choice does not deprive you of non-waivable protection under the law of your habitual residence or prevent you from using a competent court, consumer body, or regulator.

The parties will first attempt good-faith resolution through info@visionular.com, ordinarily for 30 days. If unresolved, a business user agrees to exclusive jurisdiction in the state or federal courts of Santa Clara County, California. A consumer may sue in any court competent under applicable law. Either party may seek interim relief for intellectual-property infringement, a security incident, or another urgent risk.

22. General

  • Entire agreement: These Terms and the documents identified in Section 2 form the entire agreement on their subject matter.
  • Severability: An invalid provision will be minimally adjusted where lawful; the remainder stays effective.
  • No waiver: Delay in exercising a right is not a waiver.
  • Assignment: You may not assign the account or agreement without Visionular's consent. Visionular may assign it in a merger, restructuring, or business transfer while preserving consumer and privacy protections and giving required notice.
  • No agency: The agreement does not create employment, partnership, joint venture, or agency.
  • Headings: Headings are for convenience and do not affect interpretation.
  • Language: Chinese and English versions are intended to be materially consistent. Chinese is the primary notice for mainland-China users and English elsewhere, subject to mandatory law.
